It is important to know that Congress is indeed working for YOU and for Big companies as well. Where they are working for YOU was to enact laws that made the USPTO make the provisional patent application, PPA, easy for anyone to file. It is like the 1040 EZ of the tax world.   • Your PPA is never reviewed until you use it for your NPA.
  • When you file your PPA it can have MANY inventive ideas covered in a SINGLE PPA! This is IMPOSSIBLE to do in an NPA and as such a PPA is an extraordinary proactive defensive tool for you to protect your inventive idea.
  • Let’s say you file your Provisional Patent Application and do not convert it to a non-provisional patent application in 1 year. While you can not “extend” your provisional patent application you can certainly file one again, given you did not publicly disclose the contents of it and did not “abandon” the work. You may even have further “improvements” to your inventive ide you might want to file  ANOTHER provision patent application. You can do this. Just know that when you file the new Provisional Patent Application the filing date of the Provisional Patent Application is the NEW date.
  • Do not let lawyers “trick” you into believing you should SKIP the the MAJOR benefits of a provisional patent application that are AT LEAST that you get ONE YEAR to determine if your idea is VIABLE before putting down $10,000 to file for a non-provisional patent application. What they SHOULD help you with is to understand that you should FIRST determine if the idea is VIABLE by virtue of actually testing the waters with the protection of the Patent Pending afforded with the Provisional Patent Application along with judicious use of a good Non Disclosure Agreement, NDA that they should prepare at no cost for you with the idea that if they help you with the PPA that you will come back to them for the NPA.
