Why should I file a Provisional Patent?
Why not just file a “Real” Patent or a non-provisional patent and be done with it ?
Because a non-provisional patent is very costly and takes a very long time to file… There is a BETTER way.. and a very simple way…
The MAIN reason Congress gave the Provisional Patent Application to us was to provide the individual inventor with the means to protect their inventive idea quickly without costing them an arm and a leg.
The provisional patent application gives the inventor 1 year, and since Dec 2010, 2 years to delay having to pay the hefty fees to convert their provisional patent application to a non-provisional patent application.
This one year gives the inventor the necessary time to find funding and or partnerships to bring their inventive idea to market.
Once you have a partnership it is rarely an issue of not having enought money to hire a patent attorney to file a non-provisional patent application and get the earlier filing date of their provisional patent application.
